1. General

Sounter is an online technology platform that facilitates the learning of languages through music, offering collaborative tools and top quality material for totally free students (that is, the use of the platform has no cost).

The Sounter websites ("Websites") and mobile applications for Android and IOS and related services (together with the Websites, the "Service"), are fully operated by Sounter Inc. Access to and use of the Service is subject to the following Terms and conditions of service ("Terms and conditions"). By accessing or using any part of the Service, you declare that you have read, understood and agree to be subject to these Terms and Conditions, including future modifications. Sounter may amend, update or change these Terms and Conditions. If we do this, we will post a notice that we have made changes to these Terms and Conditions on the websites. Likewise, with regard to the collection and use of personal data, the Privacy Policy that is understood, in turn, accepted by the User when accepting these Conditions is applicable.

2. Authorized use:

The User shall refrain from interfering with the operation of the Website, the Application or the Services, in particular, of impersonating another User or person. 3. User register:

To use the web or mobile application of Sounter you do not need to create an account to use the functions of our services, such as the search and display of letters and translations, the functions of listening, practicing and translating, in addition to accessing the entire section of contributing for the improvement of content in a course. However, if you decide to create an account in Sounter and join our student community, you will have to provide some information: username, Email, Password, Facebook Access or Google Access. It is the responsibility of the User to keep the aforementioned information updated, as appropriate.

The User must keep his password confidential and not disseminate it to other people, leaving the responsibility of the user to do what is done from his account, in the case that he detects that another user is using his account to report to Sounter through android mail @ sounter.com. Sounter may at any time suspend, cancel or delete the User's account if it considers that it has breached the Terms of use of the platform.

4. Application uses license:

Subject to the terms of these Terms and Conditions, Sounter grants you a non-transferable and non-exclusive license to download, install and use a copy of each application in the form of an object code only on a device that you own or control and uses authorized by these conditions. You may not derive or attempt to derive the source code of all or part of an Application, allow a third party to derive or attempt to derive said source code, or reverse engineer, decompile, disassemble or translate any Application or part thereof. Sounter owns all intellectual property rights and other rights over the Applications, and any changes, modifications or corrections thereto. The User will not distribute or make the Application available to the public through networks where they can be used by several devices at the same time. The User will not rent, sell, distribute, communicate to the public or sublicense. Any attempt to carry out any of the above procedures is a violation of the rights of Sounter and its licensors.

5. Intellectual and Industrial Property:

Sounter makes a declaration of intellectual and industrial property on the rights of the applications for both IOS and Android, in addition to its web application, the services provided, graphic design, interface and source code

The user is authorized only to access both mobile and web applications of Sounter for personal and non-commercial use. The user is prohibited from distributing, partially or totally transforming, reusing, or any unauthorized use of their web or mobile applications. 6. Advertising on mobile and web applications:

It is the sole responsibility of the advertiser the promotions, offers and content displayed by third parties in the mobile and web applications of Sounter.

7. Responsibility:

Through this declaration of responsibility, the User accepts that he uses the Sounter digital learning platform both in his web and mobile application forms under his own responsibility, so Sounter is not responsible for the misuse or use contrary to this document of Terms of Use.

Sounter does not guarantee the continuity of the operation of the digital platform in its different forms of distribution and services. To the extent permitted by applicable regulations. Sounter is excluded from any responsibility for damages of any nature that may be due to all the above points.

8. Modification of the terms of Use:

Sounter may, at any time and without incurring any responsibility, vary the content of the Website, the Application or the Services, interrupt the provision of all or some of the Services and functionalities or deactivate or delete all or some of the accounts, without further limitation than those established by applicable laws on the obligation to maintain records of certain operations during the corresponding legal deadlines.

9. User Disputes:

You agree that you are solely responsible for your interactions with any other User in relation to the service. Sounter will have no responsibility or obligation with respect to it. Sounter reserves the right, but has no obligation, to engage in any way in disputes between you and any other User of the Service or choose to show only certain User content submitted in connection with a subdomain.

10. Publication of the content

It is important to clarify that we, Sounter, are merely "application providers". In other words we develop collaborative applications for devices with iOS and Android systems. Our mission is to spread knowledge, inspired by the democratization and universality of education and knowledge. It is not part of us to publish any content on our platforms, being the publication therefore an exclusive faculty of our users.

For this reason, as mere facilitators of the platform, we are not responsible for the published content, which is in charge of the users. For this reason, it is very important that you, as a user, pay attention to the content you post in any of the iOS and Android apps, such as music lyrics or any other content, avoiding, for example, copyright infringement, rights of the person, such as the image, voice and name of third parties, or rights in industrial and commercial trademarks.

In relation to copyright, we assume that you will publish on our sites only free and/or licensed content that does not violate third party rights. Since we do not control the content published by our users (which is human and technologically impossible), we have the responsible behavior and common sense of our users that help to moderate the content of the applications.

Our responsibility is limited, it is important to say, to removing content, provided we receive some communication from the owners of the rights. By accepting these Terms of Use, you also agree that any content you have posted, authored or authored by third parties.
